a) MODIFICATIONS
You are authorized to make any necessary modification(s) to our products to fit your purposes.

b) UNAUTHORIZED USE
You may not place any of our products, modified or unmodified, on a diskette, CD, website or any other medium and offer them for redistribution or resale of any kind without prior written consent from our company. Any misuse or distribution of our templates/content will result in severe penalties, Deschutes Internet Solutions, LLC will pursue legal action for any losses resulting from your misuse of our content. We do not grant exclusive rights for items downloaded from our template section.

c) IMAGE USAGE
All images used in our website templates are copyrighted by their respective owners and are subject to limited use. You do not have rights to reuse the images in their modified or present forms anywhere else including other templates or websites. Further you do not have rights to resell/license/sub license/lease the images used in our templates in their modified or present forms under any circumstances.

d) ASSIGNABILITY

To the fullest extent permitted by applicable law, including but not limited to, negligence, Deschutes Internet Solutions, LLC shall not be liable to Client for any indirect, incidental, special or consequential damages (including, without limitation, damages or loss of business, lost profits, business interruption, loss of business information, or any other pecuniary loss, even if Deschutes Internet Solutions, LLC has been advised of the possibility of such damages, in connection with Deschutes Internet Solutions, LLC or with any other product or service provided by Deschutes Internet Solutions, LLC, or resulting from the use of or the inability to use the Website or any transaction entered into through or from Deschutes Internet Solutions, LLC, or from unauthorized access to or alteration of your transmissions, data, or account. Client specifically agrees that Deschutes Internet Solutions, LLC is not responsible or liable to Client or anyone else for any threatening, defamatory, obscene, offensive or illegal conduct or speech of any other party or any infringement or violation of another's rights, including intellectual property rights, rights of publicity, or rights of privacy. Deschutes Internet Solutions, LLC's liability to you for breach of this agreement is limited solely to $1.

h) Governing Law
Customer understands that for all disputes, with regard to any of KillerWebDesignCourse.com services or any term listed in this policy, the only jurisdiction that shall be used in determining liability is the court situated in Bend, Oregon, USA. If Deschutes Internet Solutions, LLC is obligated to go to court, rather than arbitration, to enforce any of its rights, or to collect any fees, you agree to reimburse Deschutes Internet Solutions, LLC for its legal fees, costs and disbursements if Deschutes Internet Solutions, LLC is successful. You agree that the Courts of the State of Oregon, Australia are the agreed and appropriate forums for any such suit, and consent to service of process by registered mail or overnight courier with proof of delivery.

i) Severability
If any term or provision of this Agreement is found to be unenforceable for any reason, this Agreement shall remain in full force and effect and shall be fully enforceable on its remaining terms and conditions.

j) Refusal Of Service
We reserve the right to refuse, cancel, or suspend service at our sole discretion.

k) Warranty
Deschutes Internet Solutions, LLC does not warranty or guarantee these templates in any manner. We cannot guarantee they will function with all 3rd party components as there is currently no certification process for such components. Browser compatibility should be tested against the demonstration templates on the demo server. Please ensure that the browsers you use will work with the templates as we can not guarantee that Deschutes Internet Solutions, LLC templates will work with all browser combinations.

l) Support
Deschutes Internet Solutions, LLC offers these templates and designs ‘as is’, with no implied meaning that they will function exactly as you wish or with all 3rd party components and modules. Furthermore, we offer no support via email or otherwise for installation, customization, etc. Deschutes Internet Solutions, LLC does not commit to technical support, but we reserve the right to respond and answer questions.

m) Refund Policy
Deschutes Internet Solutions, LLC is offering non-tangible irrevocable goods we do not issue refunds after the template purchase is made.
